Does a trust automatically protect your assets from probate? Not necessarily and certainly not if you never fund it. Lots of families end up paying for and setting up a living trust and then never retitle their accounts or real estate into the trust. So while, the trust might exist on paper, the assets still end up going through probate. And in other cases, certain assets avoid probate automatically and don’t need to be placed in a trust. Your retirement accounts, life insurance, jointly owned property and other similar accounts might just need to be set up correctly (and regularly reviewed) with proper beneficiary designations.
